Judge Rules Trump DOJ Can Keep 600+ Seized Fulton County Ballots

A federal judge in Georgia ruled on May 6, 2026, that the U.S. Department of Justice under the Trump administration may retain more than 600 boxes of 2020 election materials seized by the FBI from a Fulton County warehouse in January. U.S. District Judge J.P. Boulee rejected the county’s request to force the return of the ballots and related records, determining that Fulton County had not met the high legal threshold to prove the government acted with “callous disregard” for its rights, even while acknowledging flaws and “troubling” omissions in the FBI’s search warrant affidavit. The decision allows federal investigators to continue examining the materials as part of a probe into whether election records were properly retained or if irregularities occurred in the county, which includes Atlanta and has long been a focal point of disputes over the 2020 presidential election results.

The ruling has intensified debate over federal oversight of state election processes. Fulton County officials had argued the seizure relied on misleading information and violated constitutional protections, while the DOJ maintained it was necessary for a legitimate investigation. Supporters of the probe view the kept materials as potential evidence that could shed light on long-alleged irregularities, whereas critics, including election administrators and democracy advocates, express concern that the action revives debunked claims of widespread fraud and could chill future participation in elections. Both Democratic and Republican figures have voiced unease about the broader implications for election integrity and the use of federal power in politically charged contexts, though reactions split sharply along partisan lines on social media and in public statements.

In a related development, the Justice Department has issued a grand jury subpoena demanding the names, addresses, phone numbers, and other personal details of thousands of 2020 election workers in Fulton County—including poll workers, county employees, mobile voting bus drivers, and ballot reviewers—with no exceptions noted. Fulton County’s Board of Registration and Elections filed a motion to quash the subpoena on May 4, 2026, describing it as an escalation aimed at targeting and harassing perceived political opponents, potentially deterring volunteers from future elections. The county has not yet complied, and the matter remains pending before the court as the broader investigation proceeds.
