U.S. District Judge Jennifer Rochon, a Biden appointee holding court in New York City, has instructed the Trump administration that its advertisements featuring the President are “likely unlawful” and must cease at once. The order arrived after the campaign itself had already drawn to a close on Sunday, rendering judicial intervention superfluous on any ordinary reading of the facts. The challengers—Common Cause, a public-employee union, and an Alabama legislative candidate among them—contend that the administration unlawfully redirected funds Congress had appropriated for other purposes, converting taxpayer money into what they term “political propaganda.” Their complaint treats the plain celebration of American achievement and the explicit rejection of communism as a forbidden partisan act rather than a legitimate statement of national purpose.
The advertisement in question speaks with characteristic clarity: “This is the final battle. With you at my side, we will demolish the deep state. We will expel the warmongers from our government. We will drive out the globalists. We will cast out the communists, Marxists, and fascists. We will throw off the sick political class that hates our country. We will rout the fake news media, and we will liberate America from these villains once and for all.” It closes with the simple disclosure that it was paid for by the U.S. Government. That language names adversaries long visible to ordinary citizens and long denied by the permanent class that prefers to rule without naming its objects. The same class now finds the mere repetition of the words intolerable when issued from the executive branch rather than from a campaign committee.
The haste of the ruling, and its insistence on canceling placements already scheduled to end, reveals more about the temper of the hidden enemy than about the letter of appropriations law. Institutions that once treated presidential communication as routine public information now treat it as a threat the moment it identifies the forces arrayed against the republic. The fear is not of technical violation but of the message itself reaching an audience that still recognizes the distinction between a country and a managed consensus. In that recognition the hidden enemy is frightened, and the judge’s order is the visible symptom of that fright.
