Judge Orders Trump to Restore 900K CBP One Migrants

The Biden administration expanded the existing CBP One mobile app—originally launched in 2020 under the first Trump administration for cargo and traveler processing—beginning in January 2023. This allowed migrants from countries around the world, primarily in Latin America, to schedule appointments at U.S. ports of entry along the southern border. Upon presenting themselves at official ports rather than crossing illegally between them, many of the roughly 900,000 to 936,500 individuals who used the app were granted humanitarian parole for up to two years. This temporary legal status included work authorization and a notice to appear in immigration court to pursue asylum claims, under longstanding executive parole authority. The policy aimed to manage border flows and reduce chaotic illegal crossings by creating a structured, app-based legal pathway, though critics argued it incentivized large-scale migration and strained resources.

On his first day in office in January 2025, President Trump ended the CBP One app’s function for new migrant appointments and canceled all pending ones, later repurposing the tool as CBP Home primarily for voluntary self-deportations. In April 2025, the Department of Homeland Security issued mass termination notices via email to many of those previously paroled through the app, informing them that their status was being revoked and directing them to leave the United States immediately or face enforcement actions. This unilateral step targeted the existing parole grants without new individualized reviews in many cases, as part of a broader effort to reverse Biden-era immigration programs and prioritize stricter enforcement.

On March 31, 2026, U.S. District Judge Allison Burroughs ruled that the Trump administration’s blanket revocation of parole for these migrants was unlawful, citing failures to follow required procedural steps under federal law and DHS regulations, such as providing case-specific determinations that the original parole purposes had been served. The decision, stemming from a class-action lawsuit, orders the restoration of legal status for affected individuals who remain in the U.S. and received the notices. The administration has indicated it will likely appeal, highlighting ongoing tensions over executive immigration authority versus judicial oversight of administrative processes.
