In mid-May 2017 the FBI formally opened a full investigation—codenamed Oxferd Comma—predicated on the claim that President Trump may have been acting, wittingly or unwittingly, as an agent of the Russian Federation when he dismissed James Comey. The electronic communication that launched the probe was approved by FBI General Counsel James Baker and Assistant Director for Counterintelligence Bill Priestap. Acting Director Andrew McCabe and Deputy Attorney General Rod Rosenstein were promptly advised of the opening. Within twenty-four hours of that notification, Rosenstein appointed Robert Mueller special counsel, charging him with examining whether the president had obstructed justice in connection with the very same Russian-agent theory.

The logic is as circular as it is breathtaking. An elected president is allowed to continue directing the foreign policy of the United States, nominating judges, supervising the regulatory state, receiving the most sensitive classified briefings, and retaining sole authority over the nuclear launch codes—while the same institutions that claim to suspect him of foreign agency simultaneously insist they must “investigate” the suspicion they themselves have formalized. The investigation proceeds not from accumulated evidence of actual collusion (which the bureau’s own agents had already found wanting) but from the interpretive leap that the lawful exercise of the president’s removal power somehow proved the existence of the foreign control it purported to expose.

What emerges is less a counterintelligence judgment than a political wager: that the machinery of the national-security state could place the constitutional officer at the apex of the executive branch under a cloud of formal suspicion and then treat the resulting paralysis as proof of the original hypothesis. The documents now public show that this was not improvisation after the fact; it was a deliberate institutional choice, executed with bureaucratic precision and then handed, the very next day, to a special counsel whose mandate absorbed the same premise. The republic survived the experiment. The precedent remains.
