Cornell Suspends Palestine Protesters, Spares Rapists; James Steps In

Cornell has spent two years proving that an Ivy League administration knows exactly how to punish when the offense offends the right people. Since October 2023 the university has issued dozens of disciplinary actions against students tied to pro-Palestine encampments and disruptions, including the September 2024 career-fair protest that shut down recruiting for Boeing and L3Harris. Temporary suspensions ran past thirty. Some were campus-banned, some criminally charged, and two graduate students ended up finishing their degrees abroad rather than risk immigration detention. The Graduate and Professional Student Assembly itself noted that nearly all of those suspensions arose from pro-Palestine activity. Disorder aimed at Israel, or at the defense firms that arm her, was treated as an emergency.

The same campus, in October 2024, received a report that seven Chi Phi men had drugged and sexually assaulted a twenty-year-old student inside the fraternity house. Campus police were told weeks later. The chapter was closed. Cornell later insisted a Title IX panel imposed expulsions and suspensions, and denied that essays were offered as the sole consequence. The woman’s lawsuit says otherwise: that the accused were invited to mitigate their conduct in writing, and that only two of the seven were expelled. No criminal charges followed the original investigation. Tompkins County’s district attorney declined to prosecute, then reopened the file only after the civil complaint made the group-chat allegations public. A university that could clear a career fair of drummers in an afternoon took the better part of two years to produce a contested, half-hidden sanction for an alleged gang rape.

Governor Kathy Hochul has now answered that failure by handing the case to Attorney General Letitia James. On October 1 she signed an executive order making James special prosecutor, on the stated ground that she has lost confidence in the local district attorney, and James has said she will investigate and, if warranted, take the matter to a grand jury. She had already opened a civil review of Cornell’s protocols. The appointment is not a conversion. James remains the prosecutor who built a national reputation pursuing Donald Trump; Hochul remains the governor who governs by press release. What they have done is admit, in the only language Albany understands, that Ithaca’s dual standard had become too obvious to leave with the county. Whether James pursues the men named in the lawsuit, or merely audits the university’s paperwork, will show whether New York has discovered a victim or merely a new stage.
