For months the Democratic leadership has rehearsed a single narrative with theatrical certainty: that President Trump would invent a tale of foreign interference, declare a national emergency, dispatch federal agents to seize ballots and tabulation machines, and thereby “steal” the 2026 midterms. Senators Warner and Representative Himes went so far as to war-game the scenario, demanding that intelligence chiefs keep their phones open on Election Day so that any presidential claim could be instantly contradicted. The same voices that once treated every intelligence assessment as gospel now treat the possibility of an adverse finding as prima facie evidence of bad faith. The script is already written; only the performance remains.

Yet the statutory machinery they claim to fear is still in motion. Under the framework established by Executive Order 13848, the Office of the Director of National Intelligence must complete its post-election assessment of foreign activity within the next forty-five days. The Departments of Justice and Homeland Security then have another forty-five days to produce their impact report. Should those assessments conclude that foreign actors materially affected any contest, the resulting evidence becomes usable in federal litigation to contest results or in criminal prosecutions of those who facilitated the interference. What Democrats branded an authoritarian fantasy is, in fact, ordinary execution of law they themselves left on the books.

The administration has not been coy. Officials at Justice and Homeland Security have stated repeatedly that election and voter fraud would be investigated and prosecuted. That posture, combined with the still-pending intelligence and impact reports, means the official story of the 2026 elections is not yet closed. The same process Democrats spent months predicting would be abused remains available for legitimate use. Whether the findings ultimately support or refute their warnings, the next ninety days will determine whether the contest ends at the ballot box or continues in the courts and the docket.
