Grassley Shows Smith Mapped a Party, Indicted Only Trump

Tuesday’s hearing did what Senate oversight now does best. It put the paper on the table, let the author deny the obvious, and adjourned without a referral that would test whether the law still binds the men who once enforced it. On September 29, 2026, former special counsel Jack Smith sat voluntarily before the Senate Judiciary Committee for the session Chairman Chuck Grassley titled “Oversight of Jack Smith’s Abuse of Authority and the Targeting of Republicans and Related Matters.” Smith repeated the line he has used since the cases collapsed: he would charge a former president again on the same facts, Republican or Democrat, and he will not be silenced by threats of prosecution. The useful material came from Grassley’s whistleblower disclosures, not from that recitation. Smith’s operation obtained at least 4,782 donor checks, many for five or ten dollars, from all fifty states, the District of Columbia, and Puerto Rico, including forty-two from Iowa, carrying home addresses, signatures, and bank account and routing numbers. Under questioning he did not deny it. “Yes, we acquired financial information,” he said, calling the collection fact-gathering in “one of the most serious crimes that’s ever happened in our nation’s history.” Grassley’s answer was the one that matters: none of those donations appear in Smith’s public report, and the same circle of prosecutors had earlier killed an inquiry into the Clinton campaign.

The same production swept communications involving nearly fifty journalists and government sources, drawn from Fox News, CNN, CBS and 60 Minutes, NBC, CNBC, the Wall Street Journal, the Washington Post, Bloomberg, the Los Angeles Times, New York Magazine, the Associated Press, Reuters, NPR, the Mark Levin Show, the Media Research Center, The Federalist, and the Washington Times. The mechanism was a National Archives subpoena for text records tied to eighty-seven Trump White House phones. That file already held more than a former president. Grassley restated the earlier record and extended it: subpoenas covering on the order of four hundred Republican organizations and individuals; toll records and later message content from forty-four members of Congress, Grassley among them, taken without a filter adequate to the Speech or Debate Clause; date ranges on some demands running back to 2019 and forward to 2023. The pedigree runs through Operation Rampart Twelve in January 2021, the Willard hotel inquiry, and Arctic Frost, approved in April 2022 after Timothy Thibault, by Grassley’s account, used subordinates to approve his own opening. J.P. Cooney, later Smith’s deputy, is on record wanting the Speech or Debate Clause repealed. Smith inherited the apparatus in November 2022 and widened it. Non-disclosure orders kept the targets in the dark. One indictment issued. It was Trump. On the documents case, February 2022 emails show the FBI prepared to treat Mar-a-Lago as a spillage, not a criminal matter, and days before the search FBI officials raised doubts about probable cause, while Smith’s own staff left a classified facility unsecured.

Smith’s defense is the ordinary one for this kind of work. Toll records are non-content, Public Integrity signed off, and the predicate was January 6 and the documents. The mismatch is the inventory. A January 6 case does not need 2019 donor checks, four hundred Republican organizations, forty-four members’ message content, and the press corps’ exchanges with government sources, none of it featured in the report that was supposed to justify the enterprise. Grassley said the quiet part the next day: January 6 was the pretext, the Republican Party was the subject, and the object was a prison term that would keep Trump off the ballot. House Judiciary Chairman Jim Jordan has already referred Smith to the Justice Department over the lawmakers’ phone records. Nothing in Tuesday’s record shows that referral moving. Smith left the room uncharged, as did his team. The republic has the inventory. It does not yet have a prosecutor willing to read it as a case.
