No Democrat State Checks Citizenship on Its Voter Rolls

Not one Democratic-led state has subjected its voter rolls to a systematic citizenship audit or volunteered its records to the Department of Homeland Security for that purpose. The refusal is not an oversight; it is policy. While Republican secretaries of state have spent the past two years matching registrations against the upgraded SAVE database, Democratic officials have treated any federal inquiry as an assault on the franchise itself. They have answered Justice Department requests for unredacted rolls with lawsuits, public warnings, and claims of “intimidation.” The practical result is that the jurisdictions with the largest non-citizen populations remain the ones least willing to demonstrate that only citizens are casting ballots.

Federal investigators working from public lists and limited voluntary submissions have already flagged hundreds of thousands of potential non-citizens on the rolls of California, New Jersey, Pennsylvania, and Nevada alone. Those preliminary figures have been contested and reduced upon further review, yet the pattern is consistent: the states that most vigorously resist verification are the same ones in which the largest absolute numbers appear. Even the lower confirmed counts, and the continuing investigations that have produced arrests, are sufficient to show that the problem is not theoretical. When the cost of non-cooperation is measured in unexamined registrations rather than in proven prosecutions, the total remains large enough to decide close contests and to erode the premise that the electorate is composed solely of those entitled to vote.

What is at stake is not merely administrative hygiene but the character of self-government. A regime that systematically declines to distinguish citizens from non-citizens on the voter file has already conceded that the franchise is an instrument of demographic management rather than a right attached to membership in the polity. Christopher Caldwell has shown how the post-1960s expansion of rights into entitlements made the older distinctions of citizenship politically unenforceable; Michael Anton has argued that the refusal to defend those distinctions is itself a choice about who will govern. The Democratic states’ uniform decision to keep the rolls opaque is that choice made concrete. It leaves the question of illegal and non-citizen voting unanswered by design, and it places the burden of proof on those who still believe the American electorate should be limited to Americans.
