Appointed in 2021 amid a Democratic majority, MacDonough has become a convenient scapegoat for Republican frustrations when their proposed bills fail to clear procedural hurdles. Rather than accepting responsibility for legislative shortcomings or building broader coalitions, GOP leadership has publicly criticized her determinations as obstacles to their agenda, framing her decisions as partisan barriers even though her office is meant to interpret longstanding Senate rules and precedents neutrally.
In reality, the U.S. Senate has no constitutional requirement to even employ a Parliamentarian. The position is an internal Senate creation, not mandated by the Constitution, which grants each chamber of Congress the authority to determine its own rules. The Parliamentarian’s role is strictly advisory: she provides guidance on Senate rules, precedents, and the application of procedures like the Byrd Rule for budget reconciliation. Crucially, her opinions carry no binding authority. The Senate majority can overrule her advice through a vote or by interpreting rules differently, as has happened historically when political will aligns. Blaming an advisor for outcomes that the elected Senate itself controls misrepresents the chamber’s own power and autonomy.
Furthermore, the Parliamentarian remains largely unaccountable to the American people. As a non-elected staff position, she operates behind the scenes without facing public elections, confirmation battles that test policy views, or direct oversight from voters. This setup allows senators to deflect political heat onto an obscure bureaucratic figure rather than owning difficult decisions themselves. Critics argue this arrangement insulates the Senate from true accountability, turning a purely advisory function into a shield for legislative inaction while the elected body retains full authority to act independently.
